Terms and conditions

The ground rules of our cooperation. In plain language, just like our commitments.

1. Scope

These terms apply to all quotes, agreements and services of Dewit, Senne, Hopstraat 44, 3920 Lommel, België, company number BE 1015.587.426 ("Sendwit"). They apply between businesses. Deviations only apply if we agree on them in writing. The customer's terms do not apply unless we expressly accept them.

2. Quotes and agreement

Our quotes are without obligation and valid for 30 days. The agreement starts as soon as the customer accepts the quote in writing. The arrangements per customer, such as products, channels, packaging and carriers, are recorded in a customer file.

3. Our services

Sendwit stores the customer's goods, processes orders and ships them to consumers, shops, retailers, technicians and dealers. We can also provide additional services, such as returns processing, kitting, displays and labelling.

  • We book in deliveries within 1 working day of receipt and report any differences the same day.
  • Orders received before 18:00 ship the same working day, unless agreed otherwise.
  • We check and register returns, and report them within 3 working days.

4. Customer obligations

  • The customer provides correct and complete item data, such as dimensions, weight, barcodes and special instructions.
  • The customer delivers goods as agreed, correctly packed and labelled.
  • The customer does not deliver goods we don't accept, such as food and drink, chilled or frozen products and dangerous goods, unless we agree otherwise in writing.

5. Prices and payment

We work with a fixed price list per customer. Shipping is charged at our rates and listed separately on the invoice. We invoice monthly, itemised per order.

Invoices are payable within 30 days of the invoice date. In case of late payment, interest is due by operation of law in accordance with the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, as well as fixed compensation of 10% with a minimum of [€40].

We may adjust our prices annually. We announce any price adjustment at least 1 month in advance.

6. Liability

If we make a mistake, such as a wrong item, a forgotten order or the wrong packaging, we fix it at our own cost. In case of damage or loss during transport, we file the claim with the carrier and follow it up.

Our liability is limited to the invoice value of the service concerned in the month in which the damage occurred. We are not liable for indirect damage, such as loss of profit. Goods are stored at the customer's risk. We recommend insuring your stock yourself.

7. Force majeure

In case of force majeure, such as fire, flooding, strikes or disruptions at carriers, we may suspend our obligations for as long as the force majeure lasts. We inform the customer as soon as possible.

8. Term and termination

The agreement has no minimum term and can be cancelled monthly, without an exit fee. Termination is done in writing, with a notice period of 1 month.

At the end of the agreement, the customer receives their data as an export. The stock is ready for collection within 10 working days, once outstanding invoices have been paid. The customer receives the final invoice in advance.

9. Personal data

For the data of our customer's customers, we act as a processor. The arrangements for this are set out in a separate data processing agreement. More in our privacy statement.

10. Applicable law

These terms are governed by Belgian law. Disputes that we cannot resolve through consultation fall under the jurisdiction of the courts of Limburg, division Hasselt.
